In addition to the changes above, the Texas Legislature created Section 209.017 of the Texas Property Code, entitled “Justice Court Jurisdiction.” This section allows for an owner within a property owners’ association to file suit against the association in the justice court for the precinct where all or part of the association is located for violation of the Texas Residential Property Owners Protection Act, codified at Section 209 of the Texas Property Code.[1] This section is only applicable to actions brought against an association on or after September 1, 2021.[2]
